Will I lose my license automatically if I refuse or fail a breath test?
Nothing in law is automatic. You have a right to contest the officer's decision to stop your vehicle and arrest you for DWI. You have 15 days after an arrest to request a hearing in front of an Administrative Law Judge to determine these issues. If you don't request a hearing, you will lose your license within 40 days.
