The Sixth Amendment to the U.S. Constitution provides that an accused has a Right to Counsel at every meaningful step in the court system. In most DWI cases this will be the first day an individual goes to court to answer for his charge. However, if a police officer or other court official is asking questions of the accused while he is under arrest, then the accused has a right to counsel and must be informed of that right.
