Nowadays we see more and more blood tests in DWI cases. The reason is because Harris and counties around the state are having what are called no refusal weekends. That means if a person refuses a breath test the police are going to go out and get a search warrant to stick a needle in your arm and take your blood. Even if you fail a blood test, that doesn't mean that the case is lost. We are going to do whatever we can to attack that blood test and get it thrown out. We can attack the warrant itself. May be is was drawn up incorrectly, maybe there was no probable cause, maybe it wasn't returned properly, as is required by law. We can also attack the blood evidence itself. May be there was a problem with the way the medical technician took the blood or maybe there was a problem with the way it was transported or stored, or with the testing itself. That blood evidence will still be out there because we will make sure it's preserved and we will get our own experts to test it, because if we could find a way to get that test thrown out, the odds of winning your case go way up. |
