Attorney Matthew Alford talks about field sobriety tests and how important it is to hire an attorney to assist you with these allegations.
DWI is an opinion crime and what I mean by that is you are arrested and charged based on the opinion of that officer. He bases his opinion largely on how you perform on those field sobriety tests out there at the scene. He is always going to say you failed them, otherwise he wouldn't arrest you. But just because he said you failed them doesn't mean you did. There are reasons why you might not have performed perfectly on those tests. The conditions of the roadway, the stress you are under after being stopped and harassed by the police or maybe you have a physical limitation that doesn't allow you to perform those tests. At Stradley, Chernoff and Alford, we are not going to lay down and just take his opinion as gospel. We are going to find out the real reasons why you may not have done so well on those tests and get the truth out there. |
