Avoiding a DWI is not a matter of not getting caught, it’s a matter of not drinking and driving in the first place. - Limit yourself. It is perfectly legal to enjoy a few drinks before driving, as long as you are still sober. Always wait one hour in between each drink and one hour before consuming your final drink and hitting the road. It is important to note that you can still get arrested for drunk driving, even if you are under the legal limit, but this situation is very rare. If this does happen, we can often have the charges dropped as the only evidence will be the officer’s belief that you were intoxicated.
- Don’t drink at all. Some people find they cannot limit themselves to one drink per hour and are better off just not drinking at all. Try drinking soda and juices all night and you may be surprised just how good of a time you have without any alcohol.
- Walk home. If you live within walking distance, then get some exercise and just pick up your car the next day. It is important to note that in some states you can still get a DWI if you are riding a bike, ATV, even a horse, while intoxicated.
