What Is Aggravated Robbery?

Texas Penal Code Title 7, Sec. 29.03 is Texas’s aggravated robbery statute. The statute defines aggravated robbery as committing theft with intent to obtain or maintain control of another’s property while intentionally, knowingly, or recklessly:

  • Causing serious bodily injury to another person
  • Using or exhibiting a deadly weapon
  • Causing bodily injury to another person or threatening that person or placing them in fear of imminent injury or death, when the other person is disabled or 65 years old or older

Penalties for an Aggravated Robbery Conviction in Texas

Aggravated robbery is graded as a first-degree felony offense under Texas law. A conviction for aggravated robbery carries a penalty of life imprisonment or a term of incarceration falling between five to 99 years, plus a potential fine of up to $10,000. In addition, a conviction for aggravated robbery may also include restitution as part of the sentence, which requires a defendant to reimburse the victim or victims for the financial losses they suffered from the robbery.
