Houston Murder Defense Attorney Answers Frequently Asked Questions

Will I be granted bail if I am charged with homicide?

Although a magistrate may decide to grant you bail if you are facing homicide charges, most defendants who are charged with serious violent crimes such as homicide are denied bond because prosecutors and magistrates often consider defendants facing a serious criminal charge to be a flight risk. However, depending on your individual circumstances, your attorney may be able to argue for a grant of bail, particularly if you have strong ties to your community and submit to various conditions of pretrial release designed to prevent you from committing further criminal offenses or attempting to flee the jurisdiction.

Can I argue self-defense to fight my homicide charge?

A self-defense argument can be raised in defense to a homicide charge. However, to successfully prove self-defense, you would need to prove that the purported victim posed an imminent threat of serious bodily injury or death to you or another person and that the force you used in self-defense or defense of another was reasonably proportional to the force used by the purported victim.
